I (owner/participant) in the Event described below (Event) to be held on the property identified below (Property) owned/operated by the City of Council Bluffs, and utilized by the Omaha Corgi Crew, Omaha Sports Commission, or other listed below (hereafter collectively Owners and/or Sponsors). I have been informed and understand that participation in events held on the Property involves risks of personal injury/injuries sustained or caused by me and other individual(s) and/or dog(s). I understand that there is an inherent risk of injury the activities associated with the "Event."
In consideration of being allowed to participate in the activities conducted by the Owner or Sponsors on the Property associated with the Event and based on my desire to participate, I assume any and all responsibility and liability for and all risks of injury/injuries and damages to me and my person or property and agree to release and waive any and all claims against the Sponsors and Owners in any way arising out of the Event and activities associated with the Event. I certify that I am not relying on any representations, instructions, assurances of safety or warnings from the Owner, Sponsors, or their agents or anyone else. I hereby release the Owners and Sponsors and their officers, directors, agents, employees, volunteers, etc., from all liability for any and every claim, demand, cause of action, whether in law or equity, present or future, whether known or unknown, whether anticipated or not, arising from or by reason of any bodily injury or personal injury, death, or damage to property resulting from, arising out of, or incident to the Event.
The term, "Event" as used herein shall be defined to mean the "Corgi Race" or "Corgi Races" to be held at Tom Hanafan Rivers Edge Park to include, but not be limited the period during Participant's and Participant's dog's presence on the subject Property.
The term "Property" as used herein shall be defined to mean the entirety of the "Tom Hanafan Rivers Edge Park" facilities and grounds commonly described and located at 4200 Avenue B, Council Bluffs, IA 51501 and the surrounding property (properties) associated with such.
Participant(s) further understand and agree to indemnify and hold Owners and Sponsors harmless from and against any and all claims, losses and damages of any kind arising out of Participant's participation including, but not limited to any injuries and damages of any kind either caused or contributed to having been caused or alleged to have been caused in any way by Participant and/or Participant's dog. Said indemnification also includes Participant's agreement to pay Owners and Sponsors legal fees associated with defending against any and all claims and lawsuits.
OWNER(S) AND SPONSORS SHALL NOT BE LIABLE TO PARTICIPANT, OR PARTICIPANTS PARENTS OR FAMILY, OR OTHERS FOR INJURY TO OR DEATH OF ANY PERSON, NOR FOR LOSS OR DAMAGE TO PROPERTY (INCLUDING THE PROPERTY OF PARTCIPANT) OCCURING ON OR ABOUT THE PROPERTY FROM ANY CAUSE WHATSOEVER EVEN IF THE DAMAGES OR INJURIES OR DEATH ARE ALLEGED TO BE THE FAULT OF OR CAUSED BY THE NEGLIGENCE, CARELESSNESS OR FAULT, WHETHER AN ACT OR OMISSION OF OWNER, ITS OFFICERS, DIRECTORS, AGENTS OR EMPLOYEES OR ARISING OUT OF ANY ACTIVITY OR CONDITION ON THE SUBJECT PROPERTY.
I understand the terms of this Agreement, have read all of its provisions, and am agreeing on my own free accord.
