Camper Acknowledgment, Assumption of Risk & Liability Waiver:
By agreeing to this purchase, you are assuming the risk and will not hold liable, Omaha Sports Commission, IRONMAN, Lake Cunningham or any direct event sponsors, volunteers, or individuals associated with organizing the IRONMAN 70.3 Omaha (Event), held June 3-8, 2026. Lake Cunningham Campground is owned and operated by Lake Cunningham Development Trust (LCDT). The event will be organized by Omaha Sports Commission (OSC). Camping and recreational activities involve inherent risks. Please read this agreement carefully before agreeing and completing your purchase.
I understand and acknowledge that camping and outdoor recreation involves inherent risks, including uneven ground, trails, and natural terrain. I understand risks related to weather conditions (heat, cold, storms, wind). I understand risks related to wildlife and insects. I understand risks related to falling tree limbs, branches and other natural hazards, especially during wind or storm conditions. I understand that campsites may include features such as curb stops, uneven ground, rocks, posts, and other fixed objects, and I accept responsibility for vehicle positioning and clearance. I understand risks related to campfires, grills, and cooking equipment. I understand risks related to water activities in or near the lake. I understand risks related to interaction with other campers and guests. I understand that utility services (including electricity, water, sewer, and internet) may be interrupted due to weather, maintenance, equipment failure, or other unforeseen circumstances, and I accept responsibility for any related inconvenience, loss, or damage (including food spoilage). I voluntarily choose to participate in camping activities and accept responsibility for any risk of injury, illness, loss, or damage that may occur. I agree to comply with all campground rules, posted signage and staff instructions. I understand that failure to follow rules may result in removal from the campground without refund. I understand that photos or videos may be taken on Lake Cunningham property during events and campground activities for promotional, educational, or informational purposes. In the event of an emergency, I authorize the Event to seek medical treatment on my behalf (or on the behalf of minors included in my group) if I cannot be reached.
Release of Liability
To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless OSC, IRONMAN, Lake Cunningham, LCTD, and related parties of the EVENT from any and all claims, liabilities, demands, actions, or causes of action arising out of or related to my participation in camping or recreational activities at Lake Cunningham Campground, except in cases of gross negligence or willful misconduct.
